Recovery of NHS Costs

As of 29 January 2007 provisions in the Health and Social Care (Community Health and Standards) Act 2003 which allow the NHS to recover costs from businesses for treatment of workplace injuries are in effect. These new rules apply to cases where an employee, or client or customer, incurs any injury as the result of the employer's negligence which requires NHS treatment as a result. If the employer has been successfully sued for damages by the injured party, the NHS is then able to recover the costs of the treatment, within prescribed limits, from the employer. These rules are set out in the Personal Injuries (NHS Charges) (Amounts) Regulations 2007, which can be accessed via the TSO web site.
